VIOLENCE AND THE CRIMINALISATION OF MIGRATION

This lecture will examine current debates on migration and the use of criminal law in South Africa. It will examine the concurrent criminalisation of migration, under section 49(1)(a) of the Immigration Act as if it was violence and the limited state responses to physical xenophobic violence. It will then look at the legal challenges being raised in response to these developments and offer a new conceptualisation of migration as a mechanism of decolonisation in Southern Africa.
